Lawfare Denied: Teacher Barred From Wearing Hijab in J’lem Christian School

Commonsense verdict highlights the slow-burn legal attack on non-Muslim establishments everywhere – and gives the lie to the notion that only a Tiny Minority™ of ‘extremist’ Muslims fight the Jihad:
Jerusalem court rejects appeal by a Muslim teacher at a school owned by the Archdiocese of Cologne; Nadra Nimri said her rights were violated.

The Jerusalem District Labor Court last week rejected a temporary appeal by a Muslim teacher at a private Christian school to allow her to continue working after she decided to wear a hijab in class after teaching without one for 27 years.

The prestigious school, known as the Schmidt School for Girls, is run by the Blessed Virgin Mary (Mary Ward Sisters) and owned by the Archdiocese of Cologne. It is located on Nablus Road, near the Damascus Gate.

The school is open to all denominations and both Christian and Muslim girls study there. It has operated in Jerusalem for 120 years and today is classified as a recognized but unofficial school in the city’s educational system.

The hijab that the teacher, Nadra Nimri, insisted on wearing, covers her head and neck, but not her face.

When Nimri, who taught Arabic and Islam at the school, decided to wear the hijab, she first requested permission and was turned down. Despite the school’s refusal, she showed up for her classes on May 22 wearing the hijab. She was summoned to the office of the principal, Michael Kirsches, who told her she could not teach as long as she was wearing the religious garb. Nimri left the school and did not return for the rest of the school year.

In her petition to the court, she charged that the school had violated the Equal Opportunity in Work Law and the Equal Rights for Women Law.

The school argued that the school’s dress code bans the wearing of the hijab “in order to create uniformity between the students and teachers from Muslim and Christian backgrounds.

Because of this, the students are required to wear school uniforms and the teachers must serve as an example to the students in this context, as well as others.

“Wearing the hijab will harm the pedagogic and educational considerations connected to the character and substance of the school, which belongs to the Christian-Catholic community, and its desire to preserve its special and singular character.”

In their decision, judges Dita Prozhinin, Issar Salovitsky and Uri Biran wrote that although Nimri failed to present sources in Islam ordering the wearing of the hijab, the court was willing to assume there was such a stricture, and that preventing it from being upheld constituted a violation of religious freedom.

Even so, they said, there might be other factors that outweighed this. And, indeed, the court found that the fact that Schmidt was a private school and that studying there was voluntary and not compulsory made the difference.

“Given its status as a private school owned by a religious community recognized by Israel, it determined for itself the dress code that was aimed at strengthening the message of pluralism and mutual respect that the school espouses by the fact that it serves Christians and Muslims, in order to create equality and unity between religions, prevent religious coercion and social pressure and create a friendly atmosphere.

Kirsches told the court that the items of clothing that the students could wear were restricted to those specified in the dress code. The hijab was not among them.

Nimri claimed that the school had made no dress demands of the teachers, but the court rejected this argument. The teachers were also required to uphold the values of the school, which called for no differentiation between Christians and Muslims.

The judges wrote that despite her protestations, Nimri was well aware of this. When she came to the principal to ask for permission to wear it, she offered to cut her teaching position in half and teach only Islamic religion. The principal turned down the offer and continued to refuse to allow her to wear the hijab in school.

The court also rejected the argument that the school rule constituted unlawful discrimination because the ban on the hijab allegedly had nothing to do with Nimri’s obligations as a teacher.

“The rule is logically necessary based on the character and substance of the role of this specific school,” wrote the court. “There is a clear distinction between an official and an unofficial school.

In the first type, freedom of religion would outweigh other considerations and a teacher would be allowed to wear the items of clothing that were representative of his faith. That is not true in this case [of a recognized but unofficial school],” the judges said.

This kind of story seems to be repeating itself around the developed world with an alarming regularity.

It seems to happen every time secular, Christian or Jewish organisations and businesses makes moves to reach out to Muslims; whether including the community in a school, or employing them in the workplace.

In this case the ruling was sensible and appropriate – and the complaint was thrown out. But so often these days, the Islamic supremacist agenda is being upheld and supported (even promoted) by host society establishments.

The demands come gradually: first it might be a prayer room, or additional time to pray. Perhaps a request for Halal food to be served (regardless of how this may affect the feelings of non-Muslims). It usually ends up with either resigned compliance from the cornered employer, or in court; with the complainant (as in this report) complaining that their ‘rights’ were ‘denied’. It’s never too long before the labels of ‘Islamophobia’, ‘racism’, or ‘bigotry’ are hurled.

Now let’s examine what would happen if the shoe were on the other foot – and it were Muslim establishments that were coming under attack from affronted non-Muslims.

Except of course that we can’t do that. And for three basic reasons:

Muslim establishments (even if they were to employ members of the kuffar) would never countenance such challenges to the supremacy of Islam and the Sharia. Remember, non-Muslims are dhimmis (second-class citizens) in Islam

In the absence of any other major belief system having much of a desire or incentive to overthrow western principles of democracy and freedom of faith, speech and expression, it’s doubtful that many non-Muslims would consider such action in the first place

Western governments, legal systems and the media have become so enthralled with Muslims and the protection their interests (often at the expense of the host population), anyone speaking out is immdeiately villified and marginalised (we’re back to the ‘Islamophobia’, ‘racism’, or ‘bigotry’ brickbats again)

Furthermore, the irony of a Muslim living and working in the only State in the Middle East where she is the equal of any other member of that society – and has rights undreamed of in neighbouring Muslim countries, including the right to litigate against real or perceived breaches of them – should be lost on no-one.

But it surely will be.

Depraved Palestinians Celebrate Quadruple Israeli Murder by Hamas

JERUSALEM – Palestinian gunmen opened fire Tuesday on an Israeli car in the West Bank and killed four passengers on the eve of a new round of Mideast peace talks in Washington. The Islamic militant group Hamas claimed responsibility.

Assailants firing from a passing car riddled the vehicle with bullets as it traveled near Hebron — a volatile city that has been a flash point of violence in the past. Some 500 ultranationalist Jewish settlers live in heavily fortified enclaves in the city amid more than 100,000 Palestinians.

One of the victims was pregnant, said police spokesman Micky Rosenfeld. Israel’s national rescue service said the victims were two men and two women, and Israeli media said everyone in the car was killed.

Video broadcast live on Israel TV late Tuesday showed a white Subaru station wagon standing at an angle at the side of a road, its windows shot out and its doors dotted with bullet holes. The car was flanked by army and police vehicles and dozens of soldiers.

The attackers fled and Israeli forces set up roadblocks and carried out searches to try to catch them.
About 3,000 people joined a rally in Gaza to celebrate the attack. Hamas military wing spokesman Abu Obeida was among them and told The Associated Press: “The Qassam Brigades announces its full responsibility for the heroic operation in Hebron.”

Upon arriving in Washington for this week’s talks, Israeli Prime Minister Benjamin Netanyahu condemned the attack and said “terror will not determine Israel’s borders or the future of the settlements.” Borders and the fate of Jewish settlements on land Palestinians want for a future state are key issues in the negotiations.

President Barack Obama hopes to forge a peace agreement within one year.

Palestinian President Mahmoud Abbas was already in Washington meeting with U.S. Secretary of State Hillary Rodham Clinton when the attack took place.

Palestinian Prime Minister Salam Fayyad’s office issued a statement charging the attack was aimed at undermining his government’s effort to build international support for “the Palestinian position and ending the (Israeli) occupation.”

Hamas, a fierce rival of the Western-backed Palestinian president, expelled Abbas’ forces from Gaza in 2007 and took over the territory. Abbas has been trying to limit the Islamic militants’ reach in the West Bank, jailing activists and even cracking down on mosque preachers.

Hamas, responsible for dozens of suicide bombings in Israel, is considered a terrorist group by the U.S., Israel and European Union.

Asked about the shooting, State Department spokesman P.J. Crowley said the U.S. is aware “there are those who will do whatever they can to disrupt or derail the process.”

Israeli Defense Minister Ehud Barak promised a tough response to an attack he said was aimed at sabotaging the talks.

“Israel will not allow terrorists to raise their heads and will exact a price from the murderers and those who send them,” he said in a statement. U.N. envoy Robert Serry issued a statement condemning the attack and urging all parties “not to allow the enemies of peace to affect the negotiations about to be launched.”

There is widespread opposition to the resumption of the peace talks among Palestinians. Hamas opposes any contact with Israel and has harshly criticized Abbas for agreeing to resume the negotiations.

Opposition to resuming talks is also coming from within the Palestine Liberation Organization, an umbrella group headed by Abbas. Some Fatah activists threaten to try to depose him if he makes concessions, and several hard-line PLO groups plan a demonstration in the West Bank administrative capital of Ramallah on Wednesday to protest resumption of negotiations.

Netanyahu also faces some domestic opposition from elements of his hard-line coalition of religious and nationalist parties. He has said that protecting Israel’s security interests will be his top priority in the talks.
Heading into a meeting with Clinton, Netanyahu said in the statement he would tell her, “This criminal murder proves again the need to stand firmly on Israel’s stringent security demands, and there will be no compromise on them.”

The attack disrupted a relative lull in the West Bank. The last fatal attack occurred in June, when Palestinians opened fire on a police vehicle near Hebron and killed one officer.

It was the deadliest Palestinian attack against Israelis since March 2008, when a lone assailant gunned down eight students in a Jerusalem rabbinical seminary.

A previous U.S. launching of Israeli-Palestinian peace talks was also accompanied by deadly violence. Palestinian gunmen shot and killed an Israeli in the West Bank before then-President George W. Bush convened Israeli and Palestinian leaders for a summit in Annapolis, Maryland, in November 2007. The gunmen said the attack was “an act of protest against the Annapolis conference.”

Talking to reporters on his plane heading for Washington, Abbas called for decisive American involvement in the talks.

He said that if the two sides reach a deadlock, the Obama administration should “present bridging proposals to bridge the gap between the two positions.” In one major challenge to the first direct talks between the sides in two years, Abbas warned it would be difficult to continue negotiating if Israel fails to extend a 10-month curb on West Bank settlement construction that ends in late September. Netanyahu has not made a final decision.

One of the non-negotiable preconditions for any ‘Palestinian’ state settlement is that Israel has the right to live in peace, with secure borders. Yet one of Israel’s supposed ‘peace partners’ actually claimed responsibility for this brutal, depraved act of carnage.

Does anyone really think that these rocket-firing, murderous primitives would provide Israel with the remotest semblance of security?

Yet Obama, Hillary Clinton, the EU and the usual band of appeasers are still working to enforce their wrong-headed views on the region, in a piece of misguided faux ‘nation-building’, that will surely fail spectacularly (for the Jews); moments after the ink is dry.

They live in a dream world.

Flotilla Member Took Part in Previous Muslim Terror Operations

More revelations about the terrorist links and agenda of the Turkish IHH organisation, which was at the forefront of the Gaza Flotilla violence in May:

One of the activists who had taken part in the Gaza flotilla had participated in previous terror attacks, according to a recent report in the Turkish newspaper Hürriyet.

According to the report, Erdinç Tekir, who was wounded during the fighting which occurred after the IDF raided the Mavi Marmara on May 31, participated in a terrorist attack on a Russian ferry in the Black Sea in 1996.

The purpose of the attack was to bargain for the release of Chechen prisoners in Russia, and as far as is known, it was carried out by an armed group of Abkhazian/Caucasian radical Islamists, which were supported by Turkish Islamists.

Tekir recently admitted during an interview he gave to the Islamic website Dünya Bülteni, that he had participated in the terrorist attack to bargain for the release prisoners as part of his activity to promote the Chechen-Abkhazian cause, this according to a report published by the Intelligence and Terrorism Information Center.

During the same interview, Tekir said that he had been an IHH volunteer for about ten years, and that he had been introduced to the organization by friends after his release from a Turkish prison. However, he said he became close to the organization when he participated in hijacking the ferry. Tekir also said that he “struggled hard” to become a passenger on the Mavi Marmara because he wanted to make a contribution. He falsely claimed that the ship was not carrying terrorists but volunteers and activists, and that the IDF soldiers boarded the ship from the sea and air while shooting live ammunition.

The IDF raided the Mavi Marmara on May 31, after it had attempted to break a naval blockade being imposed on the Gaza Strip, claiming it was bringing humanitarian aid to Gaza. As the IDF commandos descended onto the deck of the ship by rope, they were assaulted by the activisits on the ship who were using metal clubs and knives. The activists snatched two pistols from the commandos and at them with them. Nine people were killed in the raid, most of them from Turkey, where the radical IHH group organized the flotilla.

It was later determined that there were no humanitarian supplies on the Marmara.

The report on Tekir is the first proof of the presence of a Turk with a terrorist past among the IHH operatives on board the Mavi Marmara. While there is no information indicating that the IHH was involved in the hijacking of the Russian ferry in 1996, Tekir admitted to the Islamic website that he became closer to IHH while he was active in the Abkhazian-Chechen cause.

The Intelligence and Terrorism Information Center added that its examination has shown that Tekir’s name appears on the list of names of those wounded on the Mavi Marmara, and also on the list of the hijackers of the Avrasya (the Russian ferry), a list appearing in a Wikipedia article on the attack.

This blog has been instrumental in exposing the Turkish terror-supporters of the Erdogan government-backed IHH, a supposed ‘humanitarian charity’, so we welcome this report from as further proof of what really lies behind them – and much of the so-called ‘Free Gaza’ movement.

The astounding lack of critical analysis from the media has meant that in the minds of most casual observers the people participating in these ‘flotillas’ are merely concerned, possibly slightly eccentric humanitarians, who wish nothing more than to make a stand about their perceived mistreatment of the ‘Palestinians’ by the Israelis; when in fact many are far-left radicals and hardline Islamists, who seek to delegitimise and terrorise the Jewish people and the State of Israel.

For once it seems, EU states are co-operating with Israel to stem the fake Gaza ‘aid’ boat circus:

One of two Lebanese ships due to sail to Gaza in order to break Israel’s naval blockade postponed its departure again on Sunday, amid assessments in Jerusalem that there was now only a “low probability” that it would indeed depart.

Diplomatic officials in Jerusalem said Sunday that both Cyprus and Greece had been “forthcoming” in keeping the cargo ship, the Bolivian-flagged Mariam, from setting sail from one of their ports.

AFP reported that Samar al-Hajj, one of the organizers of the new anti-blockade effort, told a news conference in Tripoli that the “trip has not been canceled but delayed.”

The organizers were still waiting for permission to use a third country as a transit point from which it could set sail for Gaza. Since Lebanon is officially at war with Israel, it is against Lebanese law for ships to sail from there directly to the Jewish state. For that reason, the organizers are looking for a third country that will allow it to use of one of its ports. So far, Greece and Cyprus have refused.

Prime Minister Binyamin Netanyahu convened a meeting on Sunday of his senior ministers, the forum known as the septet, to discuss the matter. Government sources said after the meeting that while Israel was “making all the preparations” to deal with the ship if it did indeed set sail, the feeling was that there was now only a low likelihood that this would take place.

Israel has linked the organizers, who have been talking about setting sail for Gaza since early June with some 50 women, a number of journalists and “humanitarian aid,” to Hizbullah.

Jerusalem has been working intensely behind the scenes to get the international community to place pressure on Lebanon and a number of third countries to prevent the ship from setting sail.

Time to stop this racket now – the game’s up.

After violent Turkish terror supporters on board the Mavi Marmara were exposed, in many cases by their own evidence, to be violent, Jew-hating jihadists who attempted to murder IDF personnel making a perfectly legitimate boarding of their vessel – and after a raft of evidence emerging since, showing that Gaza is experiencing nothing even approaching a ‘humanitarian crisis’ – it has become clear that the flotilla ‘movement’ is a busted flush.

It is little other than an amateurish, poorly-disguised attempt by Islamists and their left wing supporters to delegitimise Israel by breaching her borders and portraying her as an oppressor – when in fact she is anything but.

Israel delivers hundreds of truckloads of supplies week in, week out (whether or not the news cameras are there to bear witness) and also provides the ‘Palestinians’ with water, power and sewerage infrastructure – something that despite their billions of dollars of aid, they seem incapable of doing for themselves.

When Muslims stop the terror, the rockets and the blind Jew-hatred, Israel will stop retaliating – it really is as simple as that.

IAF Strike Takes Out Gaza Weapons Factory, Tunnels

Payback time – a suitably robust response from the IAF in retaliation for yet more mortar shellings yesterday:

Israel Air Force fighter pilots destroyed a variety of carefully selected terrorist targets in Gaza overnight in retaliation for a spate of terror attacks on Jewish communities in the western Negev, including two mortars fired at Israel from the region earlier in the day, and two Kassam rockets fired Monday.

Two IDF soldiers were wounded in Tuesday morning’s mortar fire while troops carried out engineering tasks along the Gaza security fence. The Salah ad-Din Brigades military wing of the Popular Resistance Committees (PRC) terrorist group subsequently claimed responsibility for the attack.

Israel has Eight Days to Strike Iranian Nuclear Plant- John Bolton

The estimable former US Envoy to the UN has warned that it will be too late after that, as the risks to innocent Iranians could be too high to contemplate:

Israel has “eight days” to launch a military strike against Iran’s Bushehr nuclear facility and stop Tehran from acquiring a functioning atomic plant, a former US envoy to the UN has said.

Iran is to bring online its first nuclear power reactor, built with Russia’s help, next week, when a shipment of nuclear fuel will be loaded into the plant’s core.

At that point, former [UN Envoy] John Bolton warned Monday, it will be too late for Israel to launch a military strike against the facility because any attack would spread radiation and affect Iranian civilians.

“Once that uranium, once those fuel rods are very close to the reactor, certainly once they’re in the reactor, attacking it means a release of radiation, no question about it,” Bolton told Fox Business Network.

“So if Israel is going to do anything against Bushehr it has to move in the next eight days.”

[Without] an Israeli strike, Bolton said, “Iran will achieve something that no other opponent of Israel, no other enemy of the United States in the Middle East really has and that is a functioning nuclear reactor.”

But when asked whether he expected Israel to actually launch strikes against Iran within the next eight days, Bolton was skeptical.

“I don’t think so, I’m afraid that they’ve lost this opportunity,” he said.

The controversial [Why? He merely recognised the irrelevance, impotence and corruption of the UN - Ed] former envoy to the United Nations criticized Russia’s role in the development of the plant, saying “the Russians are, as they often do, playing both sides against the middle.”

“The idea of being able to stick a thumb in America’s eye always figures prominently in Moscow,” he added.

Iran dismissed the possibilities of such an attack from its archfoes.

Foreign Ministry spokesman Ramin Mehmanparast said Tuesday that “these threats of attacks had become repetitive and lost their meaning.”

“According to international law, installations which have real fuel cannot be attacked because of the humanitarian consequences,” he told reporters at a news conference in Tehran.

Iranian officials say Iran has stepped up defensive measures at the Bushehr plant to protect it from any attacks.

Russia has been building the Bushehr plant since the mid-1990s but the project was marred by delays, and the issue is hugely sensitive amid Tehran’s standoff with the West and Israel over its nuclear ambitions.

The UN Security Council hit Tehran with a fourth set of sanctions on June 9 over its nuclear programme, and the United States and European Union followed up with tougher punitive measures targeting Iran’s banking and energy sectors.

The Bushehr project was first launched by the late shah in the 1970s using contractors from German firm Siemens. But it was shelved when he was deposed in the 1979 Islamic revolution.

It was revived after the death of revolutionary founder Ayatollah Ruhollah Khomeini in 1989, as Iran’s new supreme leader Ali Khamenei and his first president, Akbar Hashemi Rafsanjani, backed the project.

In 1995, Iran won the support of Russia which agreed to finish building the plant and fuel it.

The mainstream media have underplayed it, the liberals, lefties and Useful Idiots have parroted the Ahmadinejad and the Mullahs’ ‘peaceful purposes’ line; duplicitous Russia has provided the technology (for a fat profit of course), and world leaders have been wringing their hands in denial for years, applying sanctions that have clearly had precisely zero effect.

Furthermore, we believe that the United Nations has been actively concealing details of Iran’s programme for some time.

We are at a very dangerous point in history. We are now at the moment where the world’s most unstable and warmongering Muslim régime has the means to enrich Uranium and to produce a viable nuclear weapon – we are going to say that again - the means to enrich Uranium and to produce a viable nuclear weapon. Not only do they have the nuclear wherewithal, however, they also have the deployment means – Iranian missile technology is capable of ranges as far as New York, for example.

Ineffectual diplomats are trying to spin the line that Bushshr is unsuitable for producing weapons – but this is simply untrue. Paul Leventhal, of the US Nuclear Control Institute maintains that if Iran were to withdraw from the Nuclear Nonproliferation Treaty (NPT) and renounce its agreement with Russia, the Bushehr reactor could produce a quarter of a ton of plutonium per year, which Leventhal said was enough for at least 30 atomic bombs.

And now even Israel – the canary in the mine for the rest of us – and the only nation with the guts to act, has her hands tied by the so-called international community and the Islamist-infested UN.

We can’t help but wonder whether the whining left and our supposed ‘leaders’ will still be preoccupied with delegitimising the Israelis, calling them ‘war criminals’ and singing ‘Kumbaya’ for the poor Gazans when deadly Iranian nukes are whistling overhead.
